Please note that no payment is required upfront. We’ll start with a 30-minute meeting to go over everything and make sure we’re a good fit. Services like your domain, website hosting, and ongoing maintenance are not included in the package and come at an additional cost per month.
Not-For-Profit setup and registration
Determine your Eligibility
You must be a not-for-profit group with a minimum of 5 members, formed for a community benefit purpose (e.g., education, charity, culture, sports, advocacy).
Choosing a Name
- Choosing a unique name ending with “Incorporated” or “Inc.”
- Registering with the ASIC
Constitution Creation
Creating a custom constitution, which:
- Aligns with the Associations Incorporation Act 2009
- Includes provisions for membership, committee, meetings, dispute resolution, finances, etc.
- Be lodged for approval with your application
Providing the Founding General Meeting Agenda
Such as:
- Approve the constitution
- Resolve to incorporate
- Elect the first committee members (President, Secretary, Treasurer, etc.)
- Template for proper recording of minutes
Lodging Application with NSW Fair Trading
Application within 1 month of the resolution to incorporate.
Required Documents:
- Application for incorporation form
- Copy of the constitution (if not using the model)
- Founding meeting minutes
- Application fee
Once approved, you’ll receive:
- A Certificate of Incorporation
- An Incorporation Number (INC number)
This makes your association a legal entity
Registering for Tax & Legal Obligations
With the Australian Taxation Office (ATO), we apply for:
- An ABN (Australian Business Number)
- Tax Concessions, if eligible (Once registered with the ACNC)
- Deductible Gift Recipient (DGR) status, if eligible (Once registered with the ACNC)
With the Australian Charities and Not-for-profits Commission (ACNC):
- Register with the ACNC for charity status and compliance
Assist with Bank Account Setup & Record Keeping
Opening a bank account in the association’s name
- Use the INC number and ABN
- Keep detailed financial and meeting records
- Ensure annual financial statements are prepared and lodged if required
Ongoing Obligations
- Annual General Meeting (AGM) must be held within 6 months of the financial year-end
- Annual summary of financial affairs must be lodged with NSW Fair Trading
Maintain proper records and update NSW Fair Trading on:
- Constitution changes
- Public officer changes
- Address changes
- Membership or structure changes

We handle that too. We make sure your business name is available and register it properly with the right government platforms.
